The Energy Infrastructure and Impact Office was formed in 1975 when the Legislature passed a coal severance tax.  Over the decades, the Legislature has modified the parameters of the loans and the funding available. In 2017 during the 65th Legislative Assembly, Senate Bill 2272 raised the amount of the Coal Development Trust Fund (CDTF) available for school loans from $50 million to $60 million and changed the loan program to focus on unanticipated construction, replacement, and emergency repair projects limited to $2 million per district.

 

Eligible Applicants

School Construction Loans are available through the Department of Public Instruction under N.D.C.C. § 15.1-36-02. To be eligible for a loan the school district must demonstrate a need based on an unanticipated construction project, an unanticipated replacement project, or an emergency repair.

The minimum loan amount is two hundred fifty thousand dollars and the maximum loan amount for which a school district may qualify is two million dollars.

If an application is approved, the Superintendent of Public Instruction shall approve the construction, purchase, repair, improvement, modernization, or renovation of any public school building or facility (or any other improvement to real property owned by the district) before commencement of the project if the cost of the project, as estimated by the school board, is in excess of $150,000.

Coal Impact Loans are available through the Board of University and School Lands under N.D.C.C. § 57-62-03, authorizing loans to coal development-impacted counties, cities, and school districts before or after the beginning of actual coal mining from moneys deposited in the coal development trust fund.
